PARTICIPANT TERMS AND CONDITIONS.
This Agreement sets forth the terms and conditions of your participation in activities, programs, and contributions with Prison Yoga Project (PYP). In this Agreement, “Community Website” refers to PYP’s online platform currently located at community.prisonyoga.org, as well as any future iterations or replacements of that platform.
1. Content and Participation
The undersigned participant (“I,” “me,” or “my”) agrees to deliver contributions, including but not limited to presentations, recorded content, and instructional materials, at the dates and times specified and agreed upon in correspondence with PYP.
Limited Scope of Content Sharing
For contributions delivered as part of the Yoga Teacher Training (YTT) program, I acknowledge that my recorded materials and content will only be shared with the specific cohort for which I am presenting. These materials will not be made available to a broader audience beyond that cohort unless I explicitly provide written consent.
I also understand that I may request that my lecture session be available only to a live cohort and not recorded. If I choose this option, PYP will ensure my session remains exclusively live and will not be distributed as recorded content.
Additionally, I may request the removal or restriction of my personal materials and intellectual property from the cohort’s access to the Community Website at any time by submitting a written request to PYP. PYP will honor such requests promptly to ensure respect for the presenter’s ownership and boundaries.
2. Licensing and Use of Contributions
I hereby grant PYP a limited, nonexclusive, royalty-free license to use, reproduce, display, and distribute my contributions within the agreed-upon context of the training or programming for which they were created.
Restriction on Redistribution: For contributions delivered to specific programs (e.g., YTT cohorts), my content will not be redistributed, repurposed, or used outside of that program without prior written approval.
Derivative Works: PYP may create derivative works for training or marketing purposes, but only in ways that preserve the integrity and context of my original contribution. PYP will seek prior consent if any edits significantly alter the content or message.
3. Rights to Name, Image, and Likeness
I grant PYP the right to use my name, voice, biography, photograph, and likeness in its current or modified form solely for purposes related to the agreed-upon program or training. This may include promotional or educational materials as long as the use aligns with the intended context of my contributions.
4. Compensation and Acknowledgment
I acknowledge the agreed-upon honorarium of $150 for my contribution, which will be paid within two weeks following my presentation. This honorarium constitutes full compensation for the agreed use of my contributions as outlined in this agreement.
Ongoing Use and Equity Considerations
PYP acknowledges the labor and expertise contributed by guest presenters. If content is requested for use beyond its initial purpose, PYP will consult with the presenter and explore opportunities for additional compensation or mutual benefit.
5. Representations and Warranties
I represent and warrant that:
All contributions I deliver are wholly original or appropriately licensed and free from any claims of infringement.
I have the necessary legal authority to use and grant PYP the agreed-upon rights to the content I provide.
I indemnify and hold harmless PYP, its officers, staff, and affiliates from any claims or liabilities arising from my contributions.
6. Respect for Community Integrity
I understand that PYP’s mission is to create safe, healing-centered spaces for incarcerated individuals and program participants. I trust that my contributions will be treated with the utmost respect and care to preserve their integrity and the purpose of the training.
7. Removal of Content
I reserve the right to request the removal of my intellectual property and personal materials from PYP’s Community Website or other platforms if I feel the context or integrity of my contributions is at risk.
8. Legal and Jurisdictional Considerations
This Agreement is governed by the laws of the State of California. Any disputes arising from this Agreement will be resolved within the jurisdiction of California courts. If any provision of this Agreement is found to be invalid, the remaining provisions will remain enforceable.
I confirm that I have read and understood the terms and conditions of this Agreement. By signing below, I voluntarily agree to participate under these terms, and I understand the rights and responsibilities outlined herein.
